Garter Girl Creative Pin Scheduler

JulianneSmith.com | Julianne Smith

Effective Date: October 16, 2026

1. Introduction and Acceptance of Terms

These Course & Digital Product Terms and Conditions (“Terms”) govern the purchase, access, and use of online courses, digital products, educational programs, workshops, templates, downloadable materials, and related offerings (collectively, the “Products”) sold or provided by Julianne Smith through JulianneSmith.com or associated sales and delivery platforms.

JulianneSmith.com is owned and operated by Julianne Smith, a sole proprietor operating under the Garter Girl Creative brand (“we,” “us,” or “our”).

Garter Girl Creative is an umbrella brand used by Julianne Smith for her business activities and is not a separate legal entity.

By purchasing, enrolling in, downloading, accessing, or using a Product, you agree to these Terms to the extent they are presented and validly accepted as part of your transaction.

Please read these Terms carefully before purchasing.

These Terms should be read together with our:

Website Terms of Use: https://www.juliannesmith.com/terms-of-use

Privacy Policy: https://www.juliannesmith.com/privacy-policy

Website Disclaimer: https://www.juliannesmith.com/disclaimer

If additional terms are presented for a particular Product at the time of purchase, those terms will control for that Product to the extent they conflict with these general Terms.

2. Products Covered by These Terms

These Terms apply to our current and future digital educational offerings, which may include:

  • Online courses and training programs.

  • Self-paced educational courses.

  • Live or recorded workshops.

  • Webinars and masterclasses.

  • Digital downloads and ebooks.

  • Worksheets, workbooks, and checklists.

  • Spreadsheets, planners, and calculators.

  • Templates and educational frameworks.

  • Video, audio, and written training materials.

  • Digital resource libraries.

  • Bundles containing multiple digital products.

  • Other digital educational products or services expressly offered under these Terms.

We may introduce, modify, rename, combine, discontinue, or retire Products over time.

These Terms are intended to apply generally to all covered Products without requiring a separate revision whenever an individual Product is added or removed.

The specific Product description and applicable checkout disclosures establish what is included in each purchase.

These Terms do not automatically govern separately contracted consulting services, physical products sold through other branded businesses, or the Garter Girl Creative Pin Scheduler application.

Those offerings may be governed by separate agreements or policies.

3. Product Descriptions and Availability

We make reasonable efforts to describe our Products accurately, including their features, format, pricing, and included materials.

However, Products may vary in their content, delivery method, duration, access arrangements, and available features.

Before purchasing, you are responsible for reviewing the applicable Product description and checkout information.

A Product may include some or all of the following, depending on what is expressly advertised:

  • Prerecorded lessons.

  • Written educational materials.

  • Downloadable resources.

  • Templates or spreadsheets.

  • Live training sessions.

  • Access to a digital learning platform.

  • Supplemental educational resources.

  • Updates or additional materials.

  • Community access or support, if expressly included.

Purchasing one Product does not automatically provide access to any other Product, future course, new program, or separately priced resource.

We may add or discontinue Products at our discretion, subject to our obligations to existing purchasers and applicable law.

4. Eligibility and Purchasing Requirements

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase Products.

By making a purchase, you represent that:

  • You are legally capable of entering into a binding agreement.

  • The information you provide during checkout is accurate.

  • You are authorized to use the selected payment method.

  • You will comply with these Terms and any applicable Product-specific conditions.

If you purchase on behalf of a business or organization, you represent that you have authority to make that purchase.

Unless the Product expressly includes a team or organizational license, the purchase grants access only to the individual purchaser or designated authorized user.

5. Pricing and Payment

Product prices are displayed on the applicable sales page or checkout at the time of purchase.

Prices may vary depending on the Product, promotion, bundle, payment option, or other applicable offer.

We reserve the right to change prices for future purchases without notice.

Price changes will not retroactively increase the amount due under a completed purchase, except as expressly agreed in an applicable payment plan or other purchase agreement.

We may use third-party checkout and payment processing services, including ThriveCart, Squarespace Commerce, and their connected payment providers.

Payments are subject to the applicable checkout and payment processor requirements.

You agree to pay the amount disclosed at checkout, including any applicable taxes or additional charges presented before purchase.

Payment Plans

Certain Products may be offered with installment payments or payment plans.

If you select a payment plan, you agree to pay the full purchase price according to the payment schedule disclosed and accepted at checkout.

A payment plan is a method of paying the agreed purchase price. It is not automatically a subscription or a month-to-month arrangement that may be canceled without further payment.

Unless the specific offer expressly provides otherwise, stopping use of the Product does not eliminate remaining payment obligations under an agreed installment plan.

If a payment fails, we may contact you to update your payment information or resolve the outstanding balance.

Where permitted by applicable law and the terms of your purchase, we may temporarily suspend Product access while an overdue payment remains unresolved.

We will not impose undisclosed fees or alter agreed payment terms without an applicable contractual or legal basis.

Recurring Subscriptions

If we offer a Product with recurring subscription billing, its price, billing frequency, renewal terms, and cancellation procedure will be disclosed separately before purchase.

Subscriptions are distinct from installment payment plans.

Any recurring billing arrangement will be governed by its disclosed terms and applicable automatic-renewal and consumer protection laws.

6. Delivery of Digital Products

Products may be delivered through:

  • Download links.

  • Email.

  • Online course platforms.

  • Customer accounts.

  • Password-protected pages.

  • Third-party digital delivery systems.

  • Other delivery methods identified at purchase.

Delivery instructions will generally be provided through the checkout process, purchase confirmation, or associated email communications.

You are responsible for providing a valid email address and checking your inbox, spam folder, and other applicable email filters.

If you do not receive your purchased Product or access instructions, please contact info@juliannesmith.com.

We will make reasonable efforts to resolve legitimate delivery and access problems.

7. Product Access and Duration

Access arrangements may differ between Products.

Some Products may be provided as downloadable files that you can retain, while others may require access through an online learning platform or another hosted service.

The access period for a Product will be determined by the terms disclosed at the time of purchase.

Where a Product advertises a specific access period, we will honor that period, subject to these Terms, applicable law, and circumstances beyond our reasonable control.

Lifetime Access

If a Product is expressly advertised as including “lifetime access,” that term will be interpreted according to the definition disclosed in the applicable offer.

Unless the offer expressly promises otherwise, lifetime access does not mean that every third-party platform, software service, or delivery technology will remain available indefinitely.

We will not use this provision to retroactively eliminate access rights expressly promised to existing purchasers.

Product Updates and Changes

We may update educational materials to reflect changes in technology, marketing practices, platforms, or other relevant subjects.

However, purchasing a Product does not automatically entitle you to all future versions, expansions, upgrades, or separately sold Products unless those benefits are expressly included in the offer.

We may discontinue the sale of a Product without automatically terminating the access rights of existing purchasers.

If a material change affects previously promised access or functionality, we will address it in accordance with the applicable purchase terms and law.

8. License to Use Purchased Materials

When you purchase a Product, you receive a limited, non-exclusive, non-transferable license to access and use its materials in accordance with these Terms and any Product-specific license.

You do not acquire ownership of the Product's intellectual property.

Personal and Internal Business Use

Unless otherwise stated, our Products are licensed for your own educational purposes and internal business use.

This means you may generally:

  • Watch purchased training materials.

  • Read and study educational content.

  • Download included files when downloading is permitted.

  • Complete worksheets and exercises.

  • Customize eligible templates for your own business.

  • Use marketing strategies and educational concepts in your own business.

  • Apply what you learn to your own marketing activities.

We recognize that many purchasers are business owners or marketing professionals. You may apply general knowledge, skills, and strategies learned from a Product in your professional work, including work performed for clients.

However, this permission does not authorize you to reproduce, redistribute, sublicense, or sell our protected educational materials.

Restrictions on Sharing and Resale

Unless a Product expressly grants broader rights or you obtain our prior written permission, you may not:

  • Share your course login or account credentials with others.

  • Give another person access to your purchased course account.

  • Distribute purchased files to other individuals or businesses.

  • Upload course videos or paid resources to publicly accessible websites.

  • Sell, sublicense, or redistribute our templates or educational materials.

  • Repackage our materials into your own course, workshop, membership, or digital product.

  • Present our original written content, videos, templates, or frameworks as your own work.

  • Remove copyright notices or other ownership information.

  • Record or reproduce protected course materials for unauthorized distribution.

  • Use our materials to create substantially copied competing educational products.

A single-user purchase does not include team, agency-wide, client, or organizational distribution rights unless those rights are expressly provided.

If you need a broader license, please contact us before sharing or distributing the materials.

9. Templates, Worksheets, and Customizable Resources

Certain Products may contain templates, spreadsheets, worksheets, planners, or other resources intended to be customized.

You may modify these materials for your own personal or internal business use, consistent with the license provided for the Product.

For example, you may customize an included marketing planner or worksheet for use in your own business.

However, customization does not transfer ownership of the underlying original material.

Unless expressly permitted, you may not resell, publicly distribute, sublicense, or provide the original or modified templates as standalone resources to others.

If a Product includes a different or broader license, the specific license provided with that Product will control.

10. Intellectual Property

All original Product content, including written materials, course videos, presentations, graphics, downloads, templates, training frameworks, and other protected works, is owned by Julianne Smith or used with appropriate permission.

These materials may be protected by copyright, trademark, and other applicable intellectual property laws.

The purchase price grants the license described in these Terms. It does not transfer intellectual property ownership.

You agree to respect applicable intellectual property rights and to use purchased materials only as authorized.

Unauthorized copying, redistribution, resale, or commercial exploitation may result in termination of access and other lawful remedies.

11. Refunds, Cancellations, and Returns

Because our offerings include different types of digital products and educational programs, refund and cancellation terms may vary by Product.

The refund policy disclosed on the applicable sales page or at checkout at the time of purchase will govern that purchase, subject to applicable law.

Some Products may be offered with a refund period or satisfaction guarantee. Others may be identified as final sale where legally permitted.

Any applicable conditions, deadlines, or exclusions will be disclosed in connection with the particular offer.

If a Product does not expressly offer a voluntary refund or cancellation right, purchases are generally final once digital access or delivery has been provided, except where a refund or other remedy is required by law.

Requesting a Refund

To request a refund or report a problem with a purchase, please contact:

info@juliannesmith.com

Include your name, the email address used at checkout, and sufficient information to identify the transaction.

We will review the request under the applicable purchase terms and legal requirements.

Nothing in these Terms limits your rights to remedies for products or services that are not delivered as promised or otherwise fail to meet applicable legal requirements.

Payment Plans and Refunds

If you purchase through a payment plan, any applicable refund or cancellation terms will be determined by the offer accepted at checkout.

A request to stop future installments does not automatically cancel an agreed payment obligation.

If a valid refund or cancellation is approved, we will address remaining payment obligations and any applicable access changes according to the relevant terms and law.

12. Chargebacks and Payment Disputes

If you believe a transaction is incorrect or you experience a problem with a Product, we encourage you to contact us so we can attempt to resolve the issue.

You retain any rights you have to dispute a payment through your card issuer, payment provider, or applicable law.

We may provide relevant transaction records, purchase terms, delivery confirmations, or access information to a payment provider when responding to a payment dispute.

We will not penalize you merely for exercising a lawful payment dispute right.

Where appropriate and legally permitted, Product access may be suspended or terminated following a reversed or unpaid transaction.

13. Customer Accounts and Account Security

Certain Products may require an account or login credentials.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable precautions against unauthorized access.

You agree not to share account credentials with unauthorized individuals.

If you believe your account has been accessed without permission, please notify us promptly.

We may take reasonable steps to protect account security, including resetting credentials or temporarily restricting access when suspicious activity is detected.

Account information and related personal data will be handled in accordance with our Privacy Policy.

14. Live Workshops, Community Features, and Support

Some Products may include live sessions, community access, group discussions, feedback opportunities, or customer support.

These features are included only when expressly identified in the applicable Product offer.

Unless otherwise stated, purchasing a self-paced Product does not include individualized consulting, private coaching, ongoing personal support, or access to future live events.

Participation Standards

If a Product includes interactive or community features, participants agree to communicate respectfully and refrain from harassment, threats, unlawful conduct, spam, or unauthorized promotion.

We may moderate or remove content that violates applicable participation rules.

We may restrict participation when reasonably necessary to protect other users or maintain the integrity of the program.

Any restriction affecting paid access will be handled consistently with the applicable purchase agreement and law.

Recordings

Live educational sessions may be recorded when disclosed to participants.

Where recordings include participant contributions, we will provide appropriate notice and obtain any permissions required by applicable law.

Private consulting communications will not automatically be treated as public course content.

15. Educational Disclaimer and No Guaranteed Results

Our Products are designed to provide marketing education, practical strategies, tools, and resources.

They do not guarantee any particular business or financial outcome.

We do not guarantee:

  • Increased revenue or profits.

  • A specific number of leads or inquiries.

  • A particular number of customers or bookings.

  • Improved search engine rankings.

  • Specific Pinterest impressions, saves, clicks, or traffic.

  • Advertising results or return on investment.

  • Particular outcomes from implementing educational materials.

Your results will depend on your business, market, resources, experience, implementation, and other factors.

Educational content does not constitute legal, financial, accounting, or tax advice.

You remain responsible for your own business decisions and implementation.

Our Website Disclaimer provides additional information:

16. Third-Party Platforms and Technology

We may use third-party services to sell, deliver, host, or support Products.

These may include checkout platforms, payment processors, email service providers, video hosting services, learning platforms, and other technologies.

Some services may require you to create an account or agree to the third party's terms.

We do not control the independent operations, policies, or availability of third-party providers.

If a third-party service experiences an interruption, we will make reasonable efforts to address access or delivery issues within our control.

Where a disruption materially affects access promised as part of your purchase, we will address the issue consistently with our obligations and applicable law.

17. Testimonials and Examples

We may share testimonials, customer experiences, case studies, or examples of business and marketing results in connection with our Products.

These examples describe particular experiences and do not guarantee that other purchasers will achieve the same outcomes.

We will make material connection disclosures where required by applicable advertising and consumer protection laws.

You should not interpret testimonials or case studies as promises of typical or guaranteed results.

18. Termination or Suspension of Access

We may suspend or terminate access to a Product when reasonably necessary because of:

  • Unauthorized sharing or resale of protected materials.

  • Fraudulent transactions.

  • Serious violations of these Terms.

  • Unlawful conduct.

  • Security concerns.

  • Unresolved nonpayment under an applicable purchase agreement.

Where appropriate, we may provide notice and an opportunity to resolve the issue.

Termination will not affect rights or remedies that cannot legally be excluded.

We will not arbitrarily terminate paid access that was expressly promised as part of a purchase.

If we discontinue a Product or delivery platform, we will address existing access obligations in accordance with the terms applicable at purchase and relevant law.

19. Privacy and Customer Information

We collect and process information necessary to administer purchases, deliver Products, manage customer relationships, and provide support.

Our Privacy Policy describes these practices, including our use of Squarespace, ThriveCart, ActiveCampaign, Google Analytics, and Meta Pixel.

Privacy Policy: https://www.juliannesmith.com/privacy-policy

We do not require you to agree to unrelated optional marketing communications as a condition of receiving essential purchase confirmations or access information, except where a particular lawful arrangement is clearly disclosed.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Products and educational materials are provided on an “as is” and “as available” basis, except for express commitments made in the applicable Product offer or purchase agreement.

We do not warrant that educational materials will produce a particular outcome or that third-party platforms will remain unchanged.

We do not guarantee uninterrupted availability of third-party systems or the absence of every possible technical error.

Nothing in this section excludes express promises made at purchase or warranties and consumer protections that cannot lawfully be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Julianne Smith will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of a Product, including lost profits, lost business opportunities, or business interruption.

To the extent permitted by applicable law, our aggregate liability arising from a particular Product purchase will not exceed the amount you paid for that Product.

This limitation does not apply where prohibited by law or to liability that cannot legally be limited.

Nothing in these Terms removes your right to an applicable refund, remedy for non-delivery, or other mandatory consumer protection.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the District of Columbia, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Disputes arising from these Terms will be subject to courts of competent jurisdiction in the District of Columbia, except where mandatory consumer protection or other applicable laws provide otherwise.

Before initiating formal proceedings, we encourage you to contact info@juliannesmith.com so we can attempt to resolve the matter informally.

These Terms do not require binding arbitration or waive your right to bring a claim in court.

23. Changes to These Terms

We may update these Terms to reflect changes in our business, Products, technology, or legal requirements.

When changes are made, we will update the effective date displayed at the beginning of this document.

Updated Terms will generally apply to purchases made after their effective date.

The terms applicable to an existing purchase will not be materially changed retroactively without an appropriate legal or contractual basis.

We may introduce new Products or discontinue existing Products without revising these general Terms, provided the applicable Product descriptions and purchase conditions are accurately disclosed.

24. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.

These Terms, together with any applicable Product-specific terms and purchase disclosures, constitute the agreement concerning the purchase and use of the relevant Product.

They do not replace separately signed consulting agreements or terms governing unrelated businesses or applications.
